Surf Therapeutics Website Terms of Service

These Terms of Service ("Terms") govern your access to and use of the websites operated by Surf Therapeutics, Inc. ("Surf," "we," "us," or "our"), including the Surf public website and the Surf patient registry (collectively, the "Services"). By accessing or using the Services, you agree to these Terms. If you do not agree, you should not use the Services.

Purpose of the Services
Surf is a medical technology company engaged in research and development. The Services are provided for the following limited purposes:
To provide information about Surf and its work;
To allow individuals to sign up to receive company updates;
To allow individuals to voluntarily submit information through Surf’s patient registry in order to be contacted about potential research opportunities.
The Services are not intended to:
Provide medical advice, diagnosis, or treatment;
Enroll you in a clinical trial;
Determine eligibility for any research study; or
Create a physician-patient, healthcare provider, or therapeutic relationship.
2.
Eligibility
The Services are intended only for individuals who are 18 years of age or older. By using the Services, you represent that you meet this requirement.

Your Use of the Services
You may use the Services only for lawful purposes and in accordance with these Terms. You agree not to:
Submit false, misleading, or unlawful information;
Submit information about another person without legal authority;
Interfere with or disrupt the operation or security of the Services;
Use the Services in a way that violates applicable law or regulation.
Attempt to access systems or data not intended for you;

Information You Submit
When you submit information through the Services, including through the patient registry, you represent that:
The information is accurate to the best of your knowledge;
The information is self-reported;
You understand that submission may result in being contacted about research opportunities only if you have agreed to be contacted.
You understand that submission does not guarantee participation in any research study;
Surf does not independently verify the information you submit and is not responsible for the accuracy or completeness of user-submitted information.
5.
Patient Registry Specific Terms
The patient registry is a voluntary research-outreach program. Additional terms apply:
Submitting information does not obligate you to participate in research;
Participation is optional and may be discontinued at any time;
Research participation, if any, is governed by a separate informed consent document provided by the study sponsor or clinical site;
Surf may share registry information with contract research organizations (CROs) or clinical sites only as described in Surf’s Privacy Policy and only if you have consented to be contacted.
6.
Privacy
Your use of the Services and Surf’s collection and use of personal information are governed by the Surf Therapeutics Privacy Policy, which is incorporated by reference into these Terms.
7.
Intellectual Property
All content included in the Services—including text, graphics, logos, images, videos, and software—is owned by Surf or its licensors and is protected by intellectual property laws.
You may view and use the Services for personal, non-commercial purposes only. You may not copy, reproduce, modify, distribute, create derivative works from, or exploit any portion of the Services without Surf’s prior written permission.

Third-Party Websites and Services
The Services may contain links to third-party websites or services. Surf does not control and is not responsible for third-party content, policies, or practices. Your use of third-party sites is at your own risk.

Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, SURF DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, RELIABILITY, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE.

Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SURF SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES.
TO THE EXTENT PERMITTED BY LAW, SURF’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).

Indemnification
You agree to indemnify and hold harmless Surf and its officers, directors, employees, and affiliates from and against any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or related to:
Your use of the Services;
Your violation of these Terms;
Your submission of inaccurate or unlawful information.

Suspension and Termination
Surf may suspend or terminate your access to the Services at any time for any reason, including if we believe you have violated these Terms or applicable law.
You may stop using the Services at any time. You may request removal from the patient registry at any time as described in the Privacy Policy.
13.
Governing Law and Venue
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles. Any legal action arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in Travis County, Texas, unless otherwise required by law.
14.
Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the effective date and post the revised Terms on the Services. Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
